TERMS OF SERVICE

OVERVIEW

Welcome to hAndEarth Artisan Pottery. Throughout these Terms, the words “we”, “us” and “our” refer to hAndEarth Artisan Pottery. We operate this website and online store, along with all information, features, tools, products, and services offered through it (together, the “Services”). Our store is hosted on Shopify, which provides us with the platform that enables us to deliver these Services to you.

These Terms of Service (the “Terms”), together with any policies linked or referenced here, set out your rights and obligations when you access or use the Services.

Please read them carefully, as they contain important details about your legal rights, including limitations of liability and disclaimers of warranties. By accessing or using the Services in any way, you agree to these Terms and to our Privacy Policy. If you do not agree, you should not continue to use the Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm that you are of legal age in your place of residence. If you permit minors who depend on you to use the Services on devices you own or control, you are responsible for ensuring they do so in compliance with these Terms.

When creating an account or placing an order, you must provide accurate, complete, and current details (such as your email address and billing or shipping information). You represent that you have the authority to supply this information. Supplying false or outdated details may result in suspension or termination of your account.

You are responsible for safeguarding your account login and password, as well as for any activity carried out under your account. You agree not to share your password, and you must notify us immediately if you become aware of any unauthorized access. Usernames must not infringe on others’ rights or misuse trademarks.

SECTION 2 - OUR PRODUCTS

We aim to show our products and services as accurately as possible in our online shop. However, the colors, textures, and details you see may look different depending on your screen, device, or settings.

We do not guarantee that any product or service will meet your expectations or look exactly as displayed online. Product descriptions may change at any time without prior notice, and we may limit or discontinue certain items or collections as we see fit.

SECTION 3 - ORDERS

By placing an order through our website, you make an offer to purchase the selected products at the price shown at checkout, together with any applicable delivery charges and other clearly stated costs.

Before submitting your order, you will have the opportunity to review and correct any errors. When you place your order, you confirm that the order entails an obligation to pay.

After your order is placed, we will send you an email confirming that we have received it. This confirmation will include the key details of your order. A binding contract is formed when we confirm your order by email.

We reserve the right not to accept an order, for example if a product is unavailable, if there is an obvious error in the description or price, if we are unable to obtain payment authorization, or if we reasonably suspect fraud or misuse of the Services. If we cannot accept your order, we will inform you as soon as reasonably possible and refund any payment received without undue delay.

Please review your order carefully before completing checkout. Once an order has been submitted, changes or cancellations may not be possible, although we will try to assist where we reasonably can.

All prices are shown in euros (EUR). Unless otherwise expressly agreed in writing, products are sold to end customers for personal, non-commercial use. Returns, cancellations, and refunds are governed by our Refund Policy and any mandatory consumer rights that apply under applicable law.

SECTION 4 - REFUSAL OF TRANSACTION

We may remove products from our site or change website content at any time. We also reserve the right to decline any transaction or to refuse service to anyone at our discretion. We will not be liable to you or others for withdrawing a product, refusing a transaction, or canceling an order after processing has begun.

To lawfully purchase from this site, you must:

Be at least of legal age in your place of residence

Provide a valid delivery address (we do not accept PO boxes, hotels, or temporary accommodations)

Use a valid payment method accepted at checkout.

By submitting an order, you authorize us to verify your identity and payment information, including through third-party providers, to validate and approve your transactions.

SECTION 5 - PRICES AND BILLING

All prices are listed in euros (€). Our business is not registered for VAT, so no VAT is charged on our prices. Your total at checkout includes the product price and shipping charges only. Any customs duties, import taxes, clearance fees, or similar charges for deliveries outside the European Union are not included and may be collected separately by the carrier or local customs authorities. 

Prices and promotions may change without prior notice. The price you pay will be the one confirmed at checkout. If a pricing error occurs:

If the correct price is lower, you will be charged the lower price.

If the correct price is higher, we will contact you before proceeding.

Payment methods we accept are shown at checkout, including card payments and digital wallets where available.

By paying, you confirm that the payment method belongs to you and that the details are accurate. Your payment provider may validate and authorize the transaction. We are not responsible if your payment is declined.

SECTION 6 - SHIPPING AND DELIVERY

Delivery times provided are estimates only and not guarantees. We are not responsible for delays caused by carriers, customs, or events outside our control. 

SECTION 7 - INTELLECTUAL PROPERTY

All content and materials available through the Services—including text, images, graphics, trademarks, logos, videos, and designs—are owned by hAndEarth Artisan Pottery, our licensors, or Shopify, and are protected under applicable intellectual property laws.

You may access the Services for personal, non-commercial use only. Without our prior written permission, you may not copy, reproduce, distribute, adapt, display, publish, or use the materials in any way. Unauthorized use may violate copyright, trademark, or other laws.

SECTION 8 - OPTIONAL TOOLS

At times, we may provide access to third-party tools. These tools are provided “as is” without warranties or obligations. Your use of such tools is entirely at your own risk, and you should review the relevant third party’s terms before using them.

We may introduce new features or tools in the future, which will also be subject to these Terms.

SECTION 9 - THIRD-PARTY LINKS

Our Services may contain links to or integrations with third-party websites. We are not responsible for evaluating or monitoring third-party content, products, or services. If you access third-party sites, you do so at your own risk.

We are not liable for damages or issues arising from your use of third-party websites. Please carefully review their policies before completing any transactions.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Our store runs on Shopify’s platform, which enables us to provide our Services. However, all sales are directly between you and hAndEarth Artisan Pottery. Shopify is not a party to your transactions and bears no responsibility for any product, service, or dispute. 

SECTION 11 - PRIVACY POLICY

We collect and use your personal information as described in our Privacy Policy. Because our store is hosted by Shopify, your data may also be subject to Shopify’s Privacy Policy. Information may be shared with Shopify or third parties, including those outside your country of residence, to enable the Services.

SECTION 12 - FEEDBACK

If you share feedback, ideas, reviews, or suggestions with us (“Feedback”), you grant us a royalty-free, perpetual license to use, modify, publish, and display that Feedback for any purpose, including commercial use.

You represent that you own or have the rights to your Feedback, and that it does not infringe on others’ rights. We may monitor or remove Feedback at our discretion, but we are not obligated to do so.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

From time to time, the Services may contain typographical errors, inaccuracies, or omissions, including in product descriptions, pricing, or availability. We reserve the right to correct such errors or cancel orders affected by them, even after you have placed an order.

While we aim to ensure accuracy, materials on this site are provided for general information only and should not be relied upon as advice. We disclaim all liability for reliance on such content.

You must not introduce viruses, malware, or harmful code into the Services, attempt unauthorized access, or attack our site through denial-of-service or other methods.

 Violations may constitute a criminal offense. We will report breaches to law enforcement and may disclose your identity. Your right to use the Services will end immediately upon such a breach.

We are not liable for damages caused by viruses or attacks that may affect your equipment, data, or software due to use of our Services or downloads from linked sites.

SECTION 17 - ACCESSING OUR SITE

We provide access to our website on a temporary basis and may withdraw or modify it at any time without notice. We will not be liable if the site is unavailable for any period.

Access may be restricted to registered users at times. You are responsible for ensuring that anyone accessing the Services through your internet connection complies with these Terms.

SECTION 18 - TERMINATION

We may terminate or suspend your access to the Services at any time, with or without notice. You remain responsible for any amounts due up to the termination date.

Provisions relating to intellectual property, feedback, limitation of liability, and any other sections which by their nature should survive termination shall continue to apply after termination.

All information, products, and services are provided “as is” and “as available,” without guarantees of any kind. We do not warrant that the Services will be uninterrupted, error-free, or meet your expectations.

Some jurisdictions do not allow the exclusion of certain warranties; in such cases, these disclaimers may not fully apply to you.

Nothing in these Terms excludes or limits any statutory consumer rights, including the legal guarantee of conformity where applicable.

SECTION 20 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, nor does it affect any mandatory consumer rights, including your rights in relation to goods that are faulty, damaged, not delivered, or not in conformity with the contract.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential loss arising out of or in connection with your use of the Services or website, including any loss of profit, loss of business, loss of opportunity, or loss of data.

We do not exclude liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

We are not responsible for delays or failures caused by events outside our reasonable control, including carrier delays, customs delays, internet outages, or payment service interruptions.

Nothing in this Section affects your statutory rights as a consumer under applicable law.

 

SECTION 21 - SEVERABILITY

 If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent allowed by law.

SECTION 22 - WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right under these Terms does not constitute a waiver.

These Terms, along with referenced policies, form the entire agreement between you and us, overriding any prior agreements or communications.

SECTION 23 - ASSIGNMENT

You may not transfer or assign your rights under these Terms without our written consent. We may transfer or assign our rights and obligations without notice.

SECTION 24 - GOVERNING LAW

These Terms and any dispute or claim arising out of or in connection with them, the Services, or any purchase made through our website shall be governed by the laws of the Republic of Croatia.

If you are a consumer residing in another Member State of the European Union, nothing in these Terms deprives you of the protection afforded to you by mandatory provisions of the law of the country in which you have your habitual residence.

If you are a consumer, you may bring proceedings in connection with these Terms or your purchase either before the competent courts of the Republic of Croatia or before the competent courts of the country in which you are domiciled. We may bring proceedings against you only in the courts of the country in which you are domiciled, unless applicable law provides otherwise.

Headings are provided for convenience only and do not affect the interpretation of these Terms.

SECTION 26 - CHANGES TO TERMS OF SERVICE

We may update or revise these Terms at any time by posting a new version on our website. It is your responsibility to check for updates. If we make material changes, we will notify you as required by law. Continued use of the Services after changes are posted means you accept the revised Terms.
